These Terms and Conditions apply to the use of the services offered by AMAZON FOREST BANK LTDA, with registered office at Manzana 40 Plaza Empresarial, Torre 2, Piso 10, Full Time Plus 02-5. 4to Anillo, Avenida San Martin, Calle J. SC - Bolivia., referred to as “Amazon Forest Bank”. Before using any of the services provided, the user states that he/she has read, understood and accepted all the conditions established in these Terms and Conditions of Amazon Forest Bank (“Terms and Conditions”), as well as the General Terms and Conditions of Use of the Website.
OBJECT
1.1. The Amazon Forest Bank website is a platform that consists of intermediating transactions, offering a secure way for individuals or legal entities to calculate the amount of CO2 emitted per year, create an account and a subscription to neutralize these emissions, acquire carbon credits from professional entities that seek to preserve nature and receive information and news about the carbon credit market.
1.2. By using the Amazon Forest Bank email newsletter service, the user is agreeing to the following terms and conditions indicated below, and is also subject to the anti-spam policy. Acceptance of this term is mandatory for any individual or legal entity, hereinafter referred to as the “USER”, who intends to use the services provided by Amazon Forest Bank, hereinafter referred to as the “SERVICE”, as well as all other policies and principles that govern it.
1.3. Amazon Forest Bank reserves the right to update and change the Terms and Conditions from time to time, any features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Use.
RULES OF USE
2.1. By authorizing the receipt of the Amazon Forest Bank newsletter, the USER will receive an email newsletter containing selected information about the carbon credit market applicable to the USER.
2.2. Once the USER has given consent to receive the newsletter, Amazon Forest Bank will process the personal data provided at the time of registration by including the USER in an exclusive list for sending news and updates, at no financial cost.
2.3. When completing the registration, the USER must provide a valid email account to receive the newsletters.
2.4. The sending of the Newsletter will only be made available to the USER with prior and express consent and is intended to facilitate the receipt of news and activities carried out by Amazon Forest Bank, to allow for the easy dissemination of its projects and achievements and to establish closer and more up-to-date contact with the USER.
LIMIT OF LIABILITY
3.1. Amazon Forest Bank is not responsible to third parties for the conduct of any USER of the online or offline platform.
3.2. Amazon Forest Bank is not responsible for any problems or anomalies related to hardware and software caused by technical problems on the internet, at the access point, lack of knowledge about how to operate the platform, or even resulting from undue interference by third parties. In this sense, Amazon Forest Bank is not responsible for any damages or losses eventually caused to users or third parties.
3.3. Amazon Forest Bank does not guarantee that the services, features, content, applications and other elements of the platform will meet the needs, expectations and demands of the USER, and its liability is limited to making the service and content available in sufficient circumstances for enjoyment.
3.4. Amazon Forest Bank will not be liable for the payment of indirect, consequential or emerging damages, as well as, but not limited to, lost profits, sales or revenues.
LGPD AND CONFIDENTIALITY
4.1. General Personal Data Protection Law: The Parties undertake to fully comply with the requirements of this Clause and the applicable privacy and data protection legislation in Brazil, including, but not limited to, Law 13.709/2018 (“LGPD”).
4.2. The USER, as the holder of the registered personal data, acknowledges that he/she has given Amazon Forest Bank free, express and informed consent for the processing of his/her Personal Data for the purpose of receiving newsletters through the Amazon Forest Bank website.
4.3. Amazon Forest Bank considers all information provided by the holder, especially his/her personal data, confidential, ensuring that it will be processed and stored in accordance with the provisions of the General Data Protection Law (“Law No. 13.709/2018”).
4.4. The USER acknowledges that Amazon Forest Bank may share the personal data collected and reported with third parties in the following situations: (i) with other auditing companies for legal audit purposes; (ii) to protect its interests in any conflict, including legal claims; (iii) by court order or at the request of administrative authorities with legal authority to request it.
4.5. The personal data collected by Amazon Forest Bank will be stored on servers owned by Amazon Forest Bank or contracted by Amazon Forest Bank, and efforts required by Law No. 13,709/2018 will be taken to ensure the security of its systems in the storage of such personal data.
4.4. The USER may request the deletion of their personal data collected by Amazon Forest Bank at any time. The company will make every effort to comply with all deletion requests as quickly as possible, noting, however, that depending on the specific case, it may be necessary to keep personal data stored for a specific purpose and in accordance with the legal basis provided for in Law No. 13,709/2018, in which case the data subject will be duly informed. The request for deletion of personal data will imply the cancellation of the term, if it is still in force.
4.5. By accepting the terms of this agreement, the USER expresses his/her free, express and informed consent regarding the mechanisms for storing, safeguarding and other forms of processing of personal data collected by Amazon Forest Bank, as applicable in accordance with the General Data Protection Law (Law No. 13,709/2018).
4.6. As a user of the Platform, the USER and, if a legal entity, its employees, representatives and partners will have to maintain strict confidentiality regarding all instructions, determinations and information that they may receive or have access to due to their relationship with Amazon Forest Bank. The obligation of confidentiality will persist even after the termination of the subscription. If this obligation is breached, you must compensate all pecuniary and non-pecuniary damages caused to Amazon Forest Bank.
GENERAL PROVISIONS
5.1. By accepting the “T&Cs”, the USER agrees to receive all communications sent by Amazon Forest Bank to users, such as account information, offers, promotions and market research, including via registered email or any other type of communication established during registration or within the platform, in accordance with the conditions established in the Privacy Policy.
5.2. By registering on the Platform, the USER also agrees that any notices, contracts, disclosures or other communications sent to them by Amazon Forest Bank electronically satisfy the legal communication requirements.
5.3. Amazon Forest Bank reserves the right to change, suspend, cancel, terminate or modify, at any time, in whole or in part, temporarily or permanently, features, items, functionalities, application utilities, products, content and/or forms of access offered to users of the Platform.
5.4. Amazon Forest Bank, whenever possible, but not necessarily, as long as it is within the applicable legislation, will inform the USER about changes to this Term and the conditions provided herein and in its Privacy Policy. The most updated versions will be available on the Amazon Forest Bank Website and the USER may be required to re-accept the new terms and conditions electronically. Changes to this Term of Acceptance that involve a financial burden will be made with prior notice, at least 30 (thirty) days in advance.
5.5. The USER must be 18 (eighteen) years old or have legal capacity, or be in possession of legal authorization from parents or guardians, and fully capable of consenting to the terms, conditions, obligations, affirmations, representations and warranties described in this Term of Acceptance and incorporated documents.
INTELLECTUAL PROPERTY
6.1. The platform, including all content items, is protected by copyright, trade secrets, trademarks, software registration and other intellectual property laws and treaties.
6.2. Amazon Forest Bank is the owner or licensee of all content, as well as the owner or licensee of all rights related to the platform services, which are protected by copyright laws and other intellectual property rights. In this sense, and as described above, the USER may not:
reproduce, copy, use, perform, create derivative works, republish, upload, edit, send, alter, transmit or distribute, by any means whatsoever, any parts of the platform, trademarks, materials, among others, owned by Amazon Forest Bank, without the prior written authorization of the latter;
remove or alter intellectual property notices contained in or provided through the platform.
